HART Slave Response on error

Hi,
what is the data format that slave device should send if there is a communication error?suppose i got an vertical parity error, i will set the bit in communication error byte, my question is the format..
[preamble, delimeter, address, cmd no, byte cnt, data, check byte]
what is the byte cnt in this case?And what is the data to be sent?
Note:In the spec the device response for check byte error:the response shall indicate the appropriate error in communication error status byte.No data shall be returned.
