Licensing issues & HART Protocol patents

Hello,

Our company is wishing to write some software to communicate with Hart devices. Yet in the HART-6 specification it is written that the 'Implied Token' method the protocol uses is patented.

Do we need to license authority to write Hart software so as not to infringe these patents ? Or is this only for building hardware ?

Does anyone know ?
